Terms of service

Last updated: 30 October 2026

Overview

Welcome to Vivenya. These Terms of Service (our terms and conditions, referred to below as the "Terms") govern your use of this website. Throughout this document, "we", "us", and "our" refer to Vivenya. We run this store and everything connected to it — the content, functionality, tools, and products on offer — with the aim of giving you a well-curated shopping experience (referred to as the "Services"). Our store is built on the Shopify platform, which allows us to bring these Services to you.

These Terms of Service set out what you can expect from us and what we expect from you when you use our Services. We'd encourage you to go through them carefully, since they touch on important legal points, including the disclaimer of warranties and the limitation of liability.

By browsing, engaging with, or otherwise using our Services, you're agreeing to be bound by these Terms of Service along with our Privacy Policy. If that's not something you're comfortable with, please refrain from using our Services.

Section 1 — Online Store Terms and Your Account

By agreeing to these Terms of Service, you're confirming that you've reached the age of majority wherever you happen to live. Accounts are personal to you and can't be handed off, sold, or transferred to anyone else. Keeping your login details safe is entirely your responsibility, as is anything that happens under your account.

Section 2 — General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time. You agree not to reproduce, duplicate, copy, sell or resell any part of the Services without our written permission.

Section 3 — Products or Services

We do our best to represent our products truthfully, though bear in mind that colours and finer details can look different depending on the screen you're viewing them on. We can't promise that what you receive will match the on-screen image in every respect. Descriptions of our products may be updated at any point, and we retain the right to cap quantities or pull any item from sale whenever we see fit.

Section 4 — Orders and Accuracy of Billing and Account Information

Placing an order with us amounts to making us an offer to buy. We're entitled to accept or turn down any order, for whatever reason. Nothing is finalised until we've confirmed the order and taken payment, so it's worth double-checking everything before you hit submit. You agree to provide current, complete and accurate purchase, billing and account information for every order, and to keep it up to date.

Section 5 — Prices, Payment and Changes to the Service

We may adjust our prices, or modify or discontinue any part of the Services, at any time without prior warning. Whatever price is shown when you place your order — and confirmed in the email we send afterwards — is what you'll be charged. For United States orders, the price shown is the price you pay for the product: we do not add sales tax at checkout, and any import duties or customs charges that apply are not included. For United Kingdom orders, UK prices shown on our site include VAT. Because orders are sent from outside the United Kingdom, the courier may ask you to pay import duty before your parcel is delivered, depending on the value of your order. Any such charge is set by HM Revenue & Customs, not by us, and is the customer's responsibility. Standard shipping is free on every order, with no minimum spend. Express shipping is available for $15 in the United States and £11 in the United Kingdom, typically arriving 3–5 business days after dispatch. Any shipping charge is shown at checkout before you pay.

We accept Visa, Mastercard, American Express, Discover and Diners Club credit and debit cards, as well as PayPal, Shop Pay, Apple Pay and Google Pay. The payment methods available for your order are shown at checkout and can vary by country and device; see our Payment Policy for details. It's on you to give us correct payment details and to keep them current.

Section 6 — Shipping and Delivery

Any delivery timeframes we quote are our best estimate, not a promise. We can't take responsibility for delays that stem from courier issues, customs processes, or anything else beyond our control. Your order remains our responsibility until it has been delivered to you or to someone you have asked to receive it. If a parcel goes missing or arrives damaged, let us know and we'll arrange a replacement or a full refund, as set out in our Shipping Policy.

Section 7 — Returns and Refunds

You have 14 days from delivery to tell us you want to return an item, then a further 14 days to send it back. Returns, refunds and exchanges are handled according to our separate Refund Policy.

Section 8 — Intellectual Property

Everything you find on our Services — logos, wording, images, video, audio, and how it's all put together — belongs to Vivenya or to those who've licensed material to us, and is protected under relevant intellectual property law, including copyright and trademark law. You're not permitted to copy, redistribute, alter, or pass on any of it without getting our written go-ahead first. Any rights we haven't specifically handed over remain ours.

Section 9 — Optional Tools

From time to time we might give you access to third-party tools built by outside providers. These come with no warranties or endorsement from us and are offered purely on an "as is, as available" basis. If you choose to use them, that's at your own risk, not ours.

Section 10 — Third-Party Links

You may come across third-party links on our site that lead elsewhere. We have no control over, and take no responsibility for, what you find on those external sites, and linking to them isn't an endorsement. Visiting third-party sites is done entirely at your own risk.

Section 11 — Our Relationship with Shopify

Vivenya runs on the Shopify platform, but any purchase you make is made with us, not with Shopify. Shopify has no role in and bears no responsibility for the dealings between you and Vivenya, and you agree to release Shopify and its affiliated companies from any claims connected to those dealings.

Section 12 — Personal Information

Any personal information gathered through our Services is handled in line with our Privacy Policy. Using our Services means you've read and taken on board what that policy says.

Section 13 — User Comments, Feedback and Other Submissions

Any comments, suggestions, reviews, or other feedback you send our way can be used by us — reproduced, adapted, published, shared, whatever we see fit — without payment, for as long as we like, anywhere in the world. In sending it, you're confirming that you actually own the rights to that content or otherwise have permission to share it.

Section 14 — Errors, Inaccuracies and Omissions

It's possible that typos, pricing errors, inaccuracies or omissions might crop up on our Services now and then. Should that happen, we're free to fix the mistake, and to cancel or amend orders that were placed based on incorrect information.

Section 15 — Prohibited Uses

Our Services are meant to be used lawfully. You are prohibited from using them to break the law, infringe someone's intellectual property, harass or hurt other people, spread viruses or other harmful code, harvest personal data without permission, or otherwise disrupt the Services or the people using them. Anyone found breaching these Terms of Service risks having their access cut off.

Section 16 — Termination

We're able to suspend or terminate your access to our Services at any time, with no advance notice required. Termination doesn't erase any money you owe us. Terms covering intellectual property, indemnification, and the limitation of liability remain in force even after termination.

Section 17 — Disclaimer of Warranties and Your Consumer Rights

We provide this website and its tools "as is" and "as available", without warranties of any kind, and we can't promise they will always be uninterrupted or free of errors. This disclaimer of warranties does not apply to the products you buy from us: goods must be as described, of satisfactory quality and fit for purpose. Nothing in these Terms of Service limits your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 if you are shopping from the United Kingdom.

Section 18 — Limitation of Liability

As far as the law allows, Vivenya and the people connected to it — directors, staff, agents, and licensors — won't be liable for indirect, incidental, punitive, special, or consequential damages tied to your use of our Services or products. This limitation of liability covers things like lost profits, lost data, or the cost of replacing something, regardless of the legal theory behind the claim, even where we've been told such losses might occur. Nothing in these Terms limits liability that cannot be limited by law.

Section 19 — Indemnification

You agree to indemnify and hold harmless Vivenya, Shopify, and each of their affiliates, staff, and agents for any losses, claims, or costs that arise because you've broken these Terms of Service, broken the law, or misused our Services.

Section 20 — Severability

Should any part of these Terms of Service turn out to be invalid or unenforceable under the law, that part alone will be cut out, with everything else in these Terms continuing to apply as normal.

Section 21 — Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies we reference, make up the entire agreement between you and Vivenya about how you use our Services, and they replace any earlier agreements on the subject.

Section 22 — Governing Law

These Terms of Service are governed by the laws of England and Wales, and any disputes relating to your use of our Services will fall under the jurisdiction of the courts of England and Wales.

Section 23 — Changes to Terms of Service

We may revise these Terms of Service whenever necessary. Any updates will appear on this page, and where the law requires it, we'll let you know directly. If you carry on using our Services after changes go live, that means you've accepted them.
